These Terms of Service ("Terms") govern your use of ekbequipment.com (the "Site") and any purchase of equipment from EKB Equipment LLC ("EKB Equipment," "we," "us," or "our"). Please read them before using the Site or buying from us.
By browsing the Site, submitting a form, subscribing to our newsletter, or purchasing equipment from us, you agree to these Terms. If you don't agree with them, please don't use the Site.
EKB Equipment LLC sources, inspects, and sells skid steer attachments — buckets, forks, augers, grapples, brush cutters, and similar implements — and offers paid delivery across Texas, Oklahoma, and Louisiana.
This Site is a catalog, not an online store. There is no shopping cart, no checkout, and no way to pay through this website. Listings show you what we currently have; every sale is arranged and completed directly with us by phone, text, or email. Nothing on this Site constitutes a binding offer to sell, and submitting a form does not reserve an item or create a contract.
You must be at least 18 years old and legally able to enter into a contract to purchase from us. This Site sells heavy equipment attachments and is not directed at children.
If you're buying on behalf of a business, farm, or other entity, you represent that you're authorized to do so on its behalf.
We do our best to keep the Site accurate, but please keep the following in mind:
We may decline any sale, at our discretion, for any lawful reason.
Everything we sell is used equipment. We describe condition as accurately as we can, and where we've noted a condition rating or a specific flaw, that's our honest assessment — not a guarantee of future performance.
All equipment is sold "AS IS, WHERE IS," with all faults and without any warranty of any kind. Used equipment may have wear, cosmetic damage, prior repairs, or defects that are not visible on inspection. You are buying the item in its present condition.
We did not manufacture the equipment we sell. Any original manufacturer warranty has almost certainly expired, and we do not assign, extend, or assume any manufacturer warranty. We do not provide a warranty of our own.
If we've made a specific written statement to you about a particular item, that statement stands on its own — this section is about the absence of a general warranty, not a license to misdescribe something.
We strongly encourage you to inspect any item in person before buying, and to check that it fits your machine. We're glad to set aside time for this — it's a normal part of how we do business, and we'd much rather you look first than be unhappy later.
Confirming compatibility is your responsibility. Mount style, hydraulic requirements, flow rate, machine weight and lift capacity, and coupler fit vary widely between machines. We'll share what we know about an attachment, but we can't verify what will work on your specific equipment, and a good-faith opinion from us isn't a guarantee of fit.
If you choose to buy without inspecting the item — including any purchase arranged remotely and delivered — you accept the item in its condition as delivered, subject to Section 9.
A typical purchase goes like this:
A sale is final and binding only once payment has been made and the item has been handed over or delivered. Until then, either side can walk away.
We may hold an item for you for a short period by agreement. Unless we've agreed otherwise in writing, a hold is a courtesy, not a reservation, and we may release it if we don't hear back from you.
Payment is handled directly between you and us — never through this website. We accept:

Payment is due in full at the time of pickup or delivery unless we've agreed otherwise in writing. Title and risk of loss pass to you when you take possession of the item — at pickup, or on delivery, whichever applies.
If a check is returned unpaid or an app payment is reversed, you remain responsible for the full purchase price plus any fees we're charged, and we may recover the equipment.
We deliver across Texas, Oklahoma, and Louisiana for a fee based on distance. We'll quote you a clear number before you commit — there are no surprise delivery charges added after the fact.
All sales are final. Because we sell one-of-a-kind used equipment and encourage inspection before purchase, we do not accept returns, offer refunds, or provide exchanges once a sale is complete.
Before a sale is complete — before payment and handover — you can cancel for any reason at no cost.
This policy doesn't limit any rights you have under applicable law that can't be waived by agreement. If something is genuinely not what we described it to be, contact us — we'd rather hear about it and work something out than have you stuck with a bad purchase.
Applicable sales tax is charged where required by law. If you're claiming an agricultural or other exemption, you're responsible for providing a valid exemption certificate or registration number at or before the time of sale, and for the accuracy of what you provide.
If an exemption you claimed is later found to be invalid, you're responsible for any tax, interest, and penalties that result.
Skid steer attachments are heavy industrial equipment that can cause serious injury or death if misused, improperly mounted, or paired with an unsuitable machine. Once an item is yours, you are solely responsible for:
Used equipment may be missing original guards, decals, or documentation. Restoring anything needed for safe operation is your responsibility.
To the fullest extent permitted by law, EKB Equipment disclaims all warranties of every kind, whether express, implied, or statutory, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to all equipment sold and to this Site.
The Site itself is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or that listings are complete, current, or accurate at any given moment.
To the fullest extent permitted by law, EKB Equipment, its owner, and its employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost revenue, loss of use, downtime, damage to other equipment or property, or business interruption, arising out of or related to this Site, any equipment purchased from us, or these Terms — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and even if we've been advised of the possibility of such damages.
In any event, our total aggregate liability arising out of or relating to a particular item of equipment will not exceed the amount you actually paid us for that item.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
When you contact us or sign up for restock notifications, you're asking us to get back to you, and you consent to us responding by phone, text, or email using the contact details you provided. Standard message and data rates from your carrier may apply.
If you subscribe to our newsletter, we'll email you when we have a large restock. Every newsletter includes an unsubscribe link that removes you immediately, and you can also just ask us to take you off the list. Unsubscribing from marketing email doesn't stop us from replying to you about an actual purchase or inquiry.
The content on this Site — including text, photographs, video, the EKB Equipment name, and our logo — is owned by EKB Equipment LLC and protected by copyright and trademark law. You may view and share listings normally, but you may not copy our photographs, listing text, or branding for commercial use, including relisting our equipment elsewhere, without our permission.
You agree not to use the Site to submit false or misleading information, send spam or automated bulk submissions through our forms, attempt to gain unauthorized access to any part of the Site or our staff tools, or interfere with the Site's normal operation. We rate-limit form submissions and may block access that appears abusive.
Our Privacy Policy explains what information we collect and how we handle it. It's part of these Terms by reference. The short version: we collect only what you give us, we don't run trackers or analytics, and we don't sell your information.
These Terms and any sale made under them are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Burnet County, Texas, and you and we each consent to the jurisdiction of those courts.
Before filing anything, please contact us — nearly everything is easier to resolve with a phone call.
We may update these Terms from time to time. When we do, we'll revise the "last updated" date at the top of this page. Changes apply going forward and don't retroactively change the terms of a sale that's already complete. The version in effect at the time of your purchase is the one that governs it.
Entire agreement. These Terms, together with our Privacy Policy and any written terms specific to your purchase, are the entire agreement between you and us regarding the Site and any equipment purchased, and they replace any prior discussions on those subjects.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest will remain in full effect.
No waiver. If we don't enforce a provision, that's not a waiver of our right to enforce it later.
Assignment. You may not assign your rights under these Terms without our written consent. We may assign ours in connection with a sale or reorganization of the business.
Separate businesses. EKB Equipment LLC is a separate business from EKB Forestry Mulching & Land Clearing. These Terms apply only to EKB Equipment LLC.
